01These terms

These terms cover ThunderPhone Calls, a free service from Autophonix, LLC d/b/a ThunderPhone ("ThunderPhone," "we," "us"). By using Calls you agree to them. If you do not agree, do not use Calls.

You must be 18 or older to use Calls.

Your AI assistant's own terms still apply to your use of the assistant. Our Calls Privacy Notice explains what we collect and why. If you also have a ThunderPhone business account, our Terms of Service cover that account; these terms cover Calls.

02What Calls does

You ask your AI assistant, such as ChatGPT, to phone a business for you. The assistant finds the business on Google Maps, you confirm the business and what you want, and our AI agent calls the number the business lists, runs your errand and reports back through your assistant. Calls is free.

03Limits

In short

A few calls a day, up to 5 minutes each, to US business lines (not mobiles) during their opening hours. We can refuse, cut short or stop any call, or the whole service, at any time.

  • Up to 3 calls a day per person. In Claude without sign-in, the limit applies per conversation.
  • Each call lasts at most 5 minutes. A long hold ends the call.
  • Businesses in the United States only.
  • Business landline, VoIP and toll-free numbers only. We do not call mobile numbers, or numbers whose line type we cannot confirm.
  • Only during the business's listed opening hours, when it lists them, and never before 9am or after 9pm its local time.
  • Each business gets only a few calls a day from Calls, and we space out repeat calls to the same number.
  • We never call a business that has asked not to be called.

We may change these limits, refuse any request, cut any call short, and pause or end Calls for you or for everyone, at any time and without notice.

04You direct each call

Each call is made at your direction. You choose the business and the request, and you check both before the call is placed. Confirming them is your instruction to make the call.

  • Ask only for your own errand, or one for your household that you are allowed to make.
  • Give accurate details. Our agent uses only what you give it and will not fill in missing details.
  • Give a callback number only if it is yours.
  • You are responsible for the requests you make.

05How our agent calls

  • It tells the business, before anything else, that it is an AI assistant from ThunderPhone calling for you, by your first name, and that the call is recorded. It gives the number to reach us on before hanging up, or right away if asked. It never claims to be you or a person.
  • Calls are recorded and transcribed.
  • It never gives or takes payment details. If the business needs payment or a deposit, you handle that directly.
  • It agrees to nothing beyond your request. It takes "no" for an answer.
  • If the business asks not to be called again, it ends the call, and we never call that business again.
  • It hangs up on voicemail without leaving a message.

06What you may not use Calls for

In short

Personal errands only. No marketing, harassment, emergencies, impersonation, payment or health details, or calls to people instead of businesses.

  • Marketing, sales, advertising, lead generation, fundraising, political messages, polls or surveys of any kind.
  • Harassment, threats, pranks, abuse, or repeated or nuisance calls.
  • Emergencies. Call 911 or your local emergency number.
  • Anything illegal, dangerous or deceptive.
  • Impersonating anyone, or misleading the business about who is calling or why.
  • Calling on someone else's behalf without their knowledge, or collecting information about other people.
  • Passing on or collecting payment card numbers, bank details, passwords or other financial or account credentials.
  • Passing on symptoms, diagnoses, medications, test results or other health details. Booking, moving or cancelling an appointment is fine.
  • Calling a person rather than a business, or calling a personal phone.
  • Getting around our limits, or using Calls through automated scripts.

We check every request before we call, and we refuse requests that break these rules. Refusals and limits are not a promise that we catch every misuse; you remain responsible for what you ask for.

07No guarantee of results

The business may not answer, may say no, or may get things wrong. Our AI agent can mishear, misunderstand or make mistakes, and so can the summary we send back. A booking or answer reported by Calls is only as good as what the business said on the call. Check anything important with the business directly before you rely on it.

08Disclaimers

To the extent permitted by law, Calls is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that Calls will be available, uninterrupted or error-free. We are not responsible for what businesses say or do, or for your assistant's service.

09Limitation of liability

To the extent permitted by law, ThunderPhone is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, opportunities or goodwill, arising from or relating to Calls. Our total liability for all claims relating to Calls is limited to fifty U.S. dollars (US$50).

Some places do not allow these exclusions or limits, so they may not apply to you. Nothing in these terms limits liability that cannot be limited by law, including for our fraud, gross negligence or willful misconduct.

10Ending your use

You can stop using Calls at any time. We may suspend or end your access, without notice, if we believe you have broken these terms or to protect businesses, other users or the service. The sections on results, disclaimers, liability and law survive.

11Changes

We may update these terms. We will post the new version here and change the date at the top. Using Calls after an update means you accept it.

12Governing law

The laws of the State of California, without regard to conflict-of-law rules, govern these terms. Disputes go to the state courts in San Francisco County, California or the United States District Court for the Northern District of California. Nothing in these terms takes away rights you have under consumer protection laws where you live that cannot be waived by contract.
